US EB-5 Immigration Investor Program

The Employment-based Immigration Program, Fifth Preference, also known as “EB-5” had introduced since 1990 by the U.S. Immigration Act.   The EB-5 program is one of the most efficient ways for high net worth investors to obtain a green card and live in the United States of America.

Successful applicants, their spouses and dependent children under 21 are given a conditional green card. This status can be converted into a green card (permanent residency) after two years provided the project was completed during the two-year period and each investment created a minimum of ten full-time jobs for US employees.

Sterling Immigration are authorized representatives for several large EB-5 projects which are highly sought after to the point of being oversubscribed. This demand ensures that the projects raise finance quickly and usually complete within 8 to 12 months’ maximum, while creating a minimum of 14 jobs per investment. This enables the investor to remove the conditional status from their green card well in advance of the two-year deadline.

To qualify for EB-5 Immigration Investor program, an applicant must:

  • Invest US$500,000 and proof of legal source of said investment, in a qualified project in USA (via the I-526 Petition).

  • Have a joint net worth of $1,000,000 (principal applicant and spouse), excluding the value of the primary residence and related indebtedness; OR have individual income (principal applicant) of $200,000 in each of the last 2 years and the current year; OR have joint income (principal and spouse) of $300,000 in each of the last 2 years and the current year.

  • The applicant’s investment must create 10 full-time jobs for U.S. workers within 2 years.

  • To maintain the residency status, applicant and dependents must reside in the US for 6 months each year and not be absent for more than 6 months at a time.

Program Benefits:

  • No requirements for age, education level or prior business experience.

  • No English language requirement.

  • Applicants and their families can settle anywhere they choose in the United States.

  • Spouse can work and children can enjoy the education benefits.

  • After successful completion of the program, investors and their spouse and age under 21’s dependents are given a conditional resident status in the United States, which can be converted into permanent residency after 2 years and citizenship after 5 years.

  • Once the applicant establishes that the investment of $500,000 was made in the selected project, that the new businesses have operated and the 10 full-time jobs were created within the 2-year period (or will be created within a reasonable time period), the condition attached to the visa is removed and the applicant and family receive unconditional resident status in the United States (click here for the conditions of the I-829 Petition)
